ضوابط العيب في المبيع وتطبيقاته المعاصرة في الفقه الإسلامي

Résumé: إن البيع من أكثر العقود الشائعة في الحياة اليومية، لما فيه من مصالح عامة وخاصة لدى أفراد المجتمع، ومنه فيجب أن يتم عقد البيع بصورة واضحة تخلو من الغرر والجهالة والغموض التي تفضي إلى النزاعات، وينبغي أن يكون خالياً من العيوب والتي تؤثر في سلامة العقد، لذا وضع الفقهاء ضوابط تحكم البيع بصفة عامة والعيوب التي قد تطرأ في المبيع بصفة خاصة، وهذا موضوع دراستنا فقد قمنا بضبط بعض المفاهيم التي لها علاقة مباشرة ببحثنا، ثم تطرقنا إلى الضوابط التي تصف العيب لكي يكون أكثر وضوح للتقليل من المنازعات التي يمكن أن يصل إليها أطراف العقد في حالة وجود عيب في البيع، ثم عززنا هذا البحث بأمثلة تطبيقية توضح ضوابط العيب بصفة أدق. The sale is one of the most common contracts in daily life, because of the public and private interests of the members of society, and therefore the sale contract must be done in a clear manner free from delusion, ignorance and ambiguity that lead to disputes, and free from defects that affect the integrity of the contract. Controls governing sales in general and defects that may occur in the sale in particular, and this is the subject of our study. We have set some concepts that are directly related to our research, then we touched on the controls that describe the defect in order to be more clear in order to reduce the disputes that the parties to the contract can reach in In the event of a defect in the sale, then we reinforced this research with practical examples that explain the defect’s controls more accurately
