Résumé: لقد شهدت السنوات التي تلت الحرب الباردة و إلى غاية اليوم تزايُدًا رهيبًا في التفويض الخارجي لأداء المهام العسكرية و الأمنية، وذلك بالإعتماد على ما يُعرف بـ "الشركات العسكرية و الأمنية الخاصة"، و باعتبار هذه الأخيرة شركة تجارية، و بالتالي شخصًا معنويًّا، فإنها تبعًا لذلك تتكون من مجموعة أفراد طبيعيين يُطلق عليهم "الموظفون"، هولاء اختلف الفقه القانوني الدولي في تحديد وصفهم و مركزهم القانوني، هل هم مرتزقة، مقاتلون أم مدنيون؟. نستعرض في هذا المقال المركز القانوني لموظفي الشركات العسكرية و الأمنية الخاصة أثناء النزاعات المسلحة، حيث قسمناه إلى قسمين، تناولنا في القسم الأول موظفو الشركات العسكرية و الأمنية كمرتزقة، أما القسم الثاني فتناولنا فيه وضع موظفو الشركات العسكرية و الأمنية الخاصة كمقاتلين أو مدنيين. الكلمات المفتاحية: الشركات العسكرية و الأمنية الخاصة، المرتزقة، النزاع المسلح، المقاتلين، المدنيين. Abstract The years following the cold war saw a dramatic increase in the external mandate of military and security missions, relying on private military and security companies, as a commercial and therefore legal entity made up of a group of natural persons called "employees". International legal doctrine has tried to determine their legal status under the rules of international humanitarian law: are they mercenaries, combatants or civilians? This article reviews the legal status of employees of private military and security companies in armed conflict, we divided it into two parts, we treated in the first section employees of military and security companies as mercenaries, The second part deals with the status of employees of military and security companies as combatants or civilians.
