تطور استعاب آليات الرقابة والشفافية على العملية الإنتخابية : دراسة تحليلية في تشكيل السلطة المستقلة للإنتخابات بموجب القانون العضوي 19/07 في الجزائر

Résumé: ملخص: تعتبر مسألة نزاهة وشفافية الانتخابات من أهم الركائز السليمة التي تعزز لقيام ديمقراطية حقيقية، يحترم فيها صوت الشعب وحرية اختيار ممثليه في الحكم، وتختلف الآليات القانونية في الرقابة على المسار الانتخابي من دولة إلى أخرى ، حسب الظروف السياسية والاجتماعية والاقتصادية لتلك الدول، وموقفها من الممارسة السياسية من أجل تحقيق الديمقراطية، ومن هذه الدول، الجزائر، التي غيرت نهجها السياسي والقانوني في تنظيم الانتخابات، في تشكيل سلطة مستقلة للانتخابات بموجب القانون العضوي 19/07، تحت ضغوط شعبية متصاعدة ونداءات سياسية متكررة للقوى المعارضة. ومنه ركزنا في هذ المقال العلمي على محاولة الإجابة عن السؤال التالي: إلى أي مدى تم استيعاب آليات الرقابة والشفافية على العملية الانتخابية في الجزائر، انطلاقا من تشكيل السلطة المستقلة للانتخابات؟ ؛ ومنه نفترض أن تحولات الأوضاع السياسية والاجتماعية والاقتصادية في الجزائر كفيلة بتحول تدريجي غير مكتمل نحو استيعاب آليات جديدة للرقابة والشفافية على المسار الانتخابي. الكلمات المفتاحية: الانتخابات، الجزائر، القانون العضوي 19/07، السلطة المستقلة للانتخابات، الرقابة ، الشفافية، استيعاب. Abstract: Election Transparency is one of the most important pillars in any attempt to build a true democracy, in which the people's voice and their freedom to choose their government’s representatives is heard and respected. The legal mechanisms of supervising elections differ from one country to another, depending on its social and economic conditions, as well as its views and practices regarding policy and democracy, For instance, Algeria has changed its political and legal approach about election organization, forming the Independent National Authority of Elections, which has come to being after series of tremendous popular pressure and continuous political appeals from the opposition forces. That being said, we try in this scientific article to answer the following question: To what extent have the mechanisms of supervision and transparency over the electoral process in Algeria been applied, following the formation of the Independent National Authority of Elections under the Organic Law 07/19?; From this, we assume that the changes in the political, social and economic conditions in Algeria can give birth to a gradual, but incomplete, shift towards accommodating new mechanisms of electoral process’ supervision and transparency.
