دور الجماعات الإقليمية في ترقية الاستثمار السياحي بالجزائر

Résumé: تسعى هذه الدراسة إلى تسليط الضوء على المنظومة القانونية الجزائرية الخاصة بدور الجماعات الإقليمية في ترقية الاستثمار السياحي بالجزائر من خلال تحليل النصوص القانونية والمراسيم التنفيذية المنظمة لها، وتبيان آليات الجماعات الإقليمية في ترقية الاستثمار السياحي، ومدى نجاعة تعزيز دورها من خلال التخطيط السياحي ومنح تراخيص وامتيازالاستغلال السياحي كآلية لترقية الاستثمار السياحي, وحتى يعزز دورها أكثر سمح لها المشرع بتفعيل آليات تعاونية مابين الجماعات الإقليمية لإشراكها في العملية الاستثمارية, وبما أن هذه الآليات وحدها لا تكفي، سنحاول تبيان جملة من الضمانات القانونية الإجرائية والموضوعية، وكذا الضمانات القضائية التي أوجدها المشرع الجزائري لها بهدف خلق بيئة استثمارية ومستقطبة لترقية الاستثمار السياحي. Abstracts This study seeks to shed light on the Algerian legal system for the role of regional communities in promoting tourism investment in Algeria by analyzing the legal texts and executive decrees regulating them the legislator authorized it to activate participation mechanisms based on a participatory approach for all parties interested in tourism issues. Since these mechanisms alone are insufficient, wedemonstrate through our current study a number of procedural and substantive legal guarantees, as well as judicial guarantees made by the Algerian legislator in order to create an investment and attractive environment for the promotion of tourism investment.
