جرائم الاعتياد وتطبيقاتها في قانون العقوبات
Résumé: كان موضوع دراستنا جرائم العادة وتطبيقاتها في قانون العقوبات الجزائري وهي الجرائم التي تعني تكرار الفعل الإجرامي ذاته مرتين على الأقل خلال مدة زمنية ترك المشرع للقاضي الجنائي تحديدها. ومن أهم الجرائم التي وردت في قانون العقوبات وموضوع دراستنا جرائم التسول والتشرد وجرائم الوساطة في الدعارة. والعادة في جرائم الإجهاض حيث اعتبر عنصر العادة شرطا وليس ركنا في هذه الجرائم وأيضا ظرف مشدد للعقوبة.The subject of our study was habitual crimes and their applications in the Algerian Penal Code. These are crimes that mean repeating the same criminal act at least twice within a period of time that the legislator left to the criminal judge to determine. Among the most important crimes included in the Penal Code and the subject of our study are the crimes of begging, vagrancy, and crimes of mediation in prostitution. Habit in abortion crimes, where the habit element was considered a condition and not a pillar in these crimes and also an aggravating circumstance for the penalty.
