خصوصية مبدأ التقاضي على درجتين في الجنايات في ضوء القانون رقم 17-07 The Particularity Of Double Degree Principle Of Jurisdiction In Criminal Matter In View Of The Law N° 17-07

Résumé: كرس المشرع الجزائري مبدأ التقاضي على درجتين في مادة الجنايات بموجب القانون رقم 17-07، المعدل والمتمم لقانون الإجراءات الجزائية، إلا أن هذا التكريس يتسم بالخصوصية، نظرا لتلك الإشكالات القانونية المترتبة عنه كشبه التماثل بين تشكيلة محكمة الجنايات الإبتدائية والإستئنافية، انعدام الرقابة على أعمال محكمة الجنايات الإبتدائية، تسبيب أحكام الجنايات التي لا تتماشى وتشكيلة المحكمة التي أطغى عليها العنصر الشعبي المفتقد للمؤهلات القانونية ومثل هذه الأوضاع لا تترجم المعنى الحقيقي لمبدأ التقاضي على درجتين. The Algerian legislator has adopted the double degree principle of jurisdiction in view of criminal matter through a constitutional revision of 2016 and the law n° 17-07 modifying the code of penal proceeding. This adopted principle is of particular nature, because of the problems raised within the criminal court, concerning its composition in the second degree of jurisdiction,as well as its judgments which isn’t conform to the composition of the criminal court of appeal, a such provisions, don’t reflect the veritable sense of double degree principle of jurisdiction.
