قصور التشريعات العامة والخاصة في حماية المستهلك الالكتروني

Résumé: يحظى المستهلك في الجزائر بحماية مدنية وجنائية منصوص عليها في القانون المدني وقانون العقوبات والقوانين المكملة والمتممة لهما مثل قانون حماية المستهلك، القانون المحدد للقواعد المطبقة على المعاملات التجارية. غير أن هذه النصوص لم تقدم حماية خاصة للمستهلك الالكتروني، هذا المستهلك ظل يتمتع بنفس الحماية التي منحت للمستهلك العادي إلى غاية صدور القانون رقم 18-05 المتعلق بالتجارة الالكترونية الذي منح المستهلك الالكتروني حماية خاصة تتماشى وخصوصية العقد الالكتروني. The consumer in Algeria has civil and criminal protection stipulated in the Civil Code, the Penal Code, and the complementary and complementary laws for them such as the Consumer Protection Law, the law defining the rules applicable to commercial transactions, but these texts did not provide special protection for the electronic consumer, this consumer still had the same protection that was granted For the ordinary consumer until the promulgation of Law No. 18-05 related to electronic commerce, which granted the electronic consumer special protection consistent with the privacy of the electronic contract.
