الترقية العقارية ذات الطابع التجاري- دراسة في ضوء المرسوم التنفيذي 15-281
Résumé: تم تسليط الضوء في دراستنا هذه على الترقية العقارية ذات الطابع التجاري في ظل المرسوم التنفيذي رقم 281- 15 عبر آلية الامتياز القابل للتحويل الى تنازل، من خلال التطرق الى أهم الجوانب المنظمة لهذا النوع من العقود، والتي تم استعراضها في شقين، حيث حددنا في الشق الأول شروط وكيفيات الحصول على الأوعية العقارية لإنجاز المشاريع الترقية العقارية التجارية بالإضافة الى الضوابط التي تخص المرقي العقاري المستفيد من الامتياز، أما في الشق الثاني لموضوع دراستنا فقد تم عرض الأحكام الاجرائية التي تتعلق بمنح الامتياز في مجال الترقية العقارية ذات الطابع التجاري و تحويل هذا الامتياز الى تنازل. Abstract: This study highlighted commercial real estate promotion under Executive Decree No. 281-15 through the concession mechanism، by addressing the most important aspects of this type of contract. Reviewed in two parts، we identified in the first part the mechanism for obtaining real estate receptacles for the completion of commercial real estate upgrading projects، as well as the controls for the beneficiary property upgrader. In the second part of our study، the procedural provisions relating to the granting of a concession in the field of commercial real estate promotion were introduced and converted into a waiver.
