Résumé: Our message - the foundations of the constitutional state between constitutional law and Sharia policy - dealt with a "comparative study" - in which several problems were answered to clarify this study; Because the topic is an analytical and comparative study, so we have defined our field of study in contemporary constitutional documents and in comparison to the legal aspect. From here, we divided our research into three basic discussions. The first topic dealt with the principle of the supremacy of the constitution and divided it into two demands, the first: the concept of the principle of the supremacy of the constitution, and the second the requirements of the supremacy of the constitution. As for the second topic: we dealt with the principle of separation of powers, which in turn divided into two demands, the first: the authorities of the state. And the second: the concept of separation of powers. And the third topic focused on the principle of recognition of public rights and freedoms, and we divided it into two demands as well, the first: introducing the recognition of public rights and freedoms. And the second: the characteristics of public rights and freedoms and their role in the state constitution. And from here we have concluded that the authority comes from the constitution and is necessarily restricted, and from here the constitution was the first component of the legitimate legal state
