الاختلاف في اقتضاء الأمر الوجوب وأثره في الفروع الفقهية "النكاح والطلاق نموذجا"

Résumé: (حاول هذا البحث الذي تناول أثر الاختلاف في اقتضاء الأمر الوجوب في الخلاف في الفروع الفقهية، أن يحرر بعض المفاهيم الضرورية المتعلقة بالأمر، حيث توصل البحث إلى ترجيح اشتراط العلو في الأمر، وكذلك ترجيح صرف صيغة الأمر المجردة عن القرائن إلى الوجوب، حيث تبن أن الاختيار الأصوب رغم اختيار بعض أذكياء أهل الأصول والكلام موقف التوقف في اقتضاء الأمر، باعتبار دلالته مشتركة بين الوجوب والندب والإباحة. وقد تناولت الدراسة بعض الاختلاف الفقهي في بعض الفروع الفقهية التي كان مصدر الخلاف فيها الخلاف في اقتضاء دلالة الأمر على الوجوب من عدمه، فكان أن تناول نماذج من ذلك، فتناول الخلاف في حكم النكاح بناء على الخلاف في اقتضاء الأمر به، وكذلك الخلاف في وجوب المتعة المبني على الخلاف في اقتضاء الأمر بها.. الخ.). (This research, which dealt with the impact of the difference in the necessity of the imperative in the dispute in the branches of jurisprudence, attempted to liberate some of the necessary concepts related to the matter, as the research reached the weighting of the requirement of superiority in the matter, as well as the weighting of the abstract form of the command from the presumptions to the obligation, as it was found that The most correct choice is despite the fact that some of the most intelligent people of origins and speech chose the position of stopping when necessary, given that its significance is shared between obligation, recommendation and permissibility.
