دراسة تحليلية للقانون العضوي المتعلق بقوانين المالية في الجزائر

Résumé: ملخص: تهدف هذه الدراسة لتسليط الضوء على بعض أهم مساهمات القانون العضوي رقم 18-15 المتعلق بقوانين المالية،من حيث بلورة وترسيخ مبادئ الحوكمة المالية الرشيدة وتحديث الدولة.وقد خلصت الدراسة إلى أن القانون الجديد قد أدرج آليات جديدة ستسمح بتجاوز التسيير وفق النمط التقليدي الذي يعتمد على منطق الوسائل واستهلاك الاعتمادات إلى منطق التسيير الحديث المتمحور حول النتائج انطلاقا من أهداف واضحة .كما أنها أظهرت بعض نقاط الضعف والقصور في هذا القانون الجديد والتي قد تحول دون الاستعمال الأمثل للموارد العمومية في خدمة التنمية البشرية المستدامة. Abstract: This study aims to clarify the main contributions of the new organic law 18-15 relating to the finance law (OLFL), in terms of crystallization and consolidation of the principles of good public financial governance and modernization of the sphere of the State. The study concluded that the new law has incorporated new mechanisms which will make it possible to pass from a management according to the traditional style which is based on a logic of means, and of the consumption of credits, to a logic of modern management centered on results, and based on clear objectives. She also highlighted certain weaknesses and shortcomings of this new law, which could prevent the optimal use of public resources in the service of sustainable human development.
