الشهر العقاري إجراء وجوبي لانتقال الملكية العقارية في التشريع الجزائري

Résumé: يعتبر إجراء الشهر العقاري صاحب الولاية العامة في انتقال الملكية العقارية سواء بين المتعاقدين أو بالنسبة للغير،و لكن يبدو أن هذا الإجراء المعتمد في الجزائر يعد ناقص في مضمونه مما يجعل من الأفضل الإسراع في ضبط إجراءات تعميم عملية المسح الأراضي على كامل تراب البلديات الجزائرية،مع ضرورة كذلك مراجعة أحكام القانون المدني بخصوص الملكية العقارية ليتطابق مع نظام الشهر العيني خاصة من حيث منع وحظر اكتساب الملكية بالتقادم في المناطق التي أجرت الدولة عليها عملية المسح.The real estate registration procedure is considered the holder of the general mechanism in the transfer of real estate ownership, whether between the contracting parties or with regard to others. but it seems that this procedure adopted in Algeria is deficient in its content, which makes it better to expedite the control of procedures for the generalization of the land survey process on the entire soil of the Algerian municipalities, with It is also necessary to review the provisions of the Civil Code regarding real estate ownership to conform to the system of the real estate registration, especially in terms of preventing and prohibiting the acquisition of property by prescription in the areas on which the state conducted the survey
