مصلحة المحضون بين النص القانوني والاجتهاد القضائي

Résumé: إن الحضانة من آثار الطلاق ونظم المشرع أحكامها في القانون رقم 84-11 المتعلق بشؤون الأسرة المعدل والمتمم، واستمد هذا القانون جل أحكامه من أحكام الشريعة الإسلامية بما فيها الآراء الفقهية المختلفة، كما جاء تعديل قانون الأسرة متفقا مع الاتفاقيات الإقليمية والدولية المتعلقة بحقوق الطفل التي أبرمتها الجزائر وصدقت عليها. وقد جعل المشرع في قانون الأسرة مصلحة المحضون فوق كل اعتبار من أجل تحقيق الاستقرار الأسري والاجتماعي، وجعل في ذلك للقاضي سلطة تقديرية في تقدير مصلحة المحضون ،وأردنا من خلال هذا البحث الوقوف على الضوابط التي يعتمد عليها القاضي لتأسيس أحكامه عند غياب الحكم القانوني أو عدم وضوح النص القانوني في مسألة متعلقة بالحضانة. Custody is one of the effects of divorce and the legislator regulated its provisions in Law No. 84-11 related to family affairs, amended and supplemented, and this law derived most of its provisions from the provisions of Islamic Sharia, including various jurisprudential opinions, and the amendment of the Family Law was in accordance with the regional and international conventions related to children’s rights that it concluded. Algeria has ratified it. In family law, the legislator made the child’s interest above all considerations in order to achieve family and social stability, and in this he made the judge a discretionary authority to assess the child’s interest, and we wanted through this research to identify the controls that the judge relies on to establish his rulings in the absence of the legal ruling or the lack of clarity Legal text in a matter related to custody.
