التدخل الضمني لمجلس المنافسة في نطاق الملكية الفكرية

Résumé: يتناول هذا المقال التدخل الضمني لمجلس المنافسة لضبط المنافسة في مجال الملكية الفكرية ، فنظرا للتعارض بين مبادئ قانون المنافسة و الطبيعة الإستئثارية لحقوق الملكية الفكرية ، و أن مجال الملكية الفكرية منظم بقوانينه الخاصة ، طرحت إشكالية هل يطبق قانون المنافسة على مجال الملكية الفكرية ؟ ، فكانت الإجابة بأن قوانين الملكية الفكرية منحت لصاحب الحق الفكري حقوق إستئثارية و بينت أشكال التعدي عليها و العقوبات المقررة لذلك ، في حين لم تضع عقوبات لصاحب الحق إذا تعسف في إستعمال حقه بما يضر بالمنافسة في السوق ، و بالتالي نظرا لعدم وجود نص صريح يخص تطبيق قانون المنافسة على مجال الملكية الفكرية ، و أن الملكية الفكرية هي جزء لا يتجزأ من السوق ، و مجلس المنافسة مخول لضبط المنافسة في السوق وفقا لقواعد قانون المنافسة ، فيطبق قانون المنافسة على مجال الملكية الفكرية ضمنيا ، و بما أن قانون المنافسة لا يتضمن أحكام صريحة تطبق على الملكية الفكرية إستوجب القيام بإسقاط أحكام قانون المنافسة على مجال الملكية الفكرية من خلال رصد بعض الممارسات المنافية أو المقيدة للمنافسة التي يقوم بها أصحاب الملكية الفكرية و تستدعي تدخل مجلس المنافسة . : Abstract This article deals with the tacit interference of the competition council to regulate competition in the field of intellectual property , in view of the conflict between the principles of competition law and the exclusive nature of intellectual property rights , and that the field of intellectual property is regulated by its own laws , the problem was raised whether competition law is applied to the field of intellectual property , the answer was that the intellectual property laws granted the intellectual right holder exclusive rights and indicated the forms of infringement and the penalties prescribed for that , while it did not impose penalties for the owner of the intellectual right if he abused his right to the detriment of competition in the market , therefore , due to the absence of an explicit provision regarding the application of competition law to the field of intellectual property , that intellectual property is an integral part of the market , the competition council is empowered to regulate competition in the market in accordance with the rules of competition law , the competition law is implicitly applied to the field of intellectual property , since the competition law does not contain explicit provisions that apply to intellectual property , it is necessary to overturn the provisions of the competition law on the field of intellectual property by monitoring som anti-competitive or restrictive practices carried out by intellectual property owners that require the intervention of the competition council .
