الشروط المقترنة بعقد النكاح في الفقه الإسلامي وقانون الأسرة الجزائري
Résumé: هذه الدراسة الموسومة بـ: الشروط المقترنة بعقد النكاح في الفقه الإسلامي وقانون الأسرة الجزائري كان الإشكال الرئيس فيها هو: إلى أي مدى ساير قانون الأسرة الجزائري الشريعة الإسلامية في إتباع هذه الشروط؟ وقد حاولت الدراسة من خلال ثلاثة مباحث الإجابة على ذلك. وتوصلت من خلال هذه الدراسة إلى جملة من النتائج لعل من أهمها أنه قبل اشتراط أي شرط يجب أن تراعى فيه أحكام الشريعة الإسلامية، وأن يكون موافقا لما جاءت به، كما أوصت الدراسة بضرورة توسيع هذا البحث من مختلف جوانبه، كما نوّهت بضرورة تفعيل دور الأئمة والوعاظ خاصة؛ لتحسيس المجتمع بتيسير تكاليف الزواج خاصة الـمَـهر، واشتراط شروط مقبولة وفي طاقة الزوج. This study tackles legal marriage contract's conditions in sharia(Islamic law) and the Algeria family law. We tried to find out to what extent the Algeria family law(code) is in accordance with sharia following those conditions? We answered for the questions above in three sections: We arrived through the study to many results: the most Important one is that before requiring any condition, one should take into account the previsions of sharia and that the condition is in accordance with what came in it
