الإطار القانوني للمحكمة الدولية لقانون البحار

Résumé: تختص المحكمة الدولية لقانون البحار بالنظر في النزاعات المتعلقة باستعمال واستغلال البحر وثرواته الحية وغير الحية والتي تحكم تنظيمها اتفاقية الامم المتحدة لقانون البحار بين الدول ساحلية كانت، أو وغير ساحلية وكذا الاشخاص العاملة في مجال البحار. لذا يرتكز اختصاص هذه المحكمة على حل النزاعات التي تثور بين الدول أو الأشخاص الأخرى حول تطبيق وتفسير اتفاقية الأمم المتحدة لقانون البحار. معتمدة في ذلك على نظام الغرف القضائية الذي يتناسب مع طبيعة النزاعات البحرية آخذة في ذات الاعتبار الأشخاص المتنازعين أمامها سواء أكانوا أشخاصا دولية أو أشخاصا غير الدولية. وبهذا تعتمد المحكمة في حلها للنزاعات على اتفاقية قانون البحار وكذا الاتفاقيات الدولية المبرمة بين أطراف النزاع غير المخالفة لاتفاقية الأمم المتحدة لقانون البحار كما تحل النزعات الماثلة أمامها في غياب الحل في الاتفاقيات بمصادر القانون الدولي الأخرى. Abstract: The International Tribunal on the Law of the Sea is competent to examine disputes relating to the use and exploitation of the sea and its living and non-living resources, the organization of which is governed by the United Nations Convention on the Law of the Sea. Sea between coastal states as well as people working in the fields of the seas. Thus, the jurisdiction of this Tribunal focuses on the resolution of disputes between States or other persons relating to the application and interpretation of the United Nations Convention on the Law of the Sea, Judicial chambers which is compatible with the nature of maritime disputes by taking into account the persons bringing their disputes before them, whether international or not. In order to resolve these disputes, the tribunal shall be guided by the Convention on the Law of the Sea and the international agreements between the parties to the dispute which do not contravene the United Nations Convention on the Law of the Sea, As it is competent to resolve delayed disputes arising in the absence of a solution in the Conventions through other sources of international law.
