صحة التراضي في التوقيع الالكتروني

Résumé: الملخص : يرتكز العقد على أركان أساسية يكون بوجودها وجوده وبعدمها انعدامه، وإذا اشترط العقد التقليدي الحضور المادي للمتعاقدين أو نائبيهم، فإن العقد الإلكتروني لا يشترط ذلك إنما يتم بالحضور الحكمي لهم نظراً لخصوصية انعقاده. على هذا الأساس يُمثل التراضي عنصر أساسي في العقد الالكتروني، حيث تطرح هذه المسألة أهمية بالغة كونها تتعلق بتطوير التجارة الالكترونية في ظل نقص الآليات الكافية لحماية هذه المعاملات في كيفية التأكد من صحتها، وخاصة أن المشرع الجزائري لم يُنظم أحكاماً خاصة بخصوص أهلية المتعاقدين عبر الوسائل الإلكترونية، ولا بخصوص عيوب الإرادة، إذ عالجهما في القانون المدني الأمر الذي يستدعي منا البحث في مدى ملائمة هذه القواعد لتنظيم مسألتي الأهلية والعيوب. الكلمات المفتاحية : العقد الالكتروني – العقد التقليدي - صحة التراضي – الأهلية – عيوب الإرادة. Abstract : The contract is based on basic elements that are present and non-existent, and if the traditional contract requires the physical presence of the contractors or their deputies, the electronic contract does not require this, but is done in the presence of them due to the privacy of its convening. On this basis, consent is an essential element in the electronic contract, as this issue is of great importance as it relates to the development of electronic commerce in light of the lack of adequate mechanisms to protect these transactions in how to verify their validity, especially since the Algerian legislator did not regulate special provisions regarding the eligibility of contractors through electronic means, nor regarding defects of will, as it dealt with them in the Civil Code, which requires us to examine the appropriateness of these rules to regulate the issues of eligibility and defects.
