حدود حرية الصحافة المكتوبة في التشريع الجزائري

Résumé: يحمي القانون الجزائري كل تجاوز في ممارسة الصحافة كما أشار إليه دستور 1989 في المادة 63 منه، في حين نص الدستور في مادتيه 36 و 41 على أن حرية الرأي و التعبير مضمونة ، مما يؤكد أن الصحافة تمارس عملها بكامل الحرية وذلك في إطار عناصر المجتمع الأساسية ولحماية الحريات و الحقوق و الواجبات العامة واحترام الحياة الخاصة للموطنين طبقا للقانون و الدستور. وتقوم مسؤولية الصحافة طبقا لأحكام قانون العقوبات لسنة 1966م، و قانون الإعلام لسنة 1990 و 2012 عند تجاوز حرية الصحافة الحدود المرسومة لها، وهكذا جرم المشرع الجزائري بعض التصرفات التي تعد حالات تجاوز لحرية الصحافة ، فقد وضع المشرع توازنا ، يسهر القضاء على حراسته، يضمن كفالة حرية الرأي و التعبير من ناحية ، وتحريم المساس بالغير دون وجه حق ، من ناحية أخرى. Algerian law protects every violation in the practice of the press as it was referred in the Constitution of 1989 in Article 63, while the Constitution in its articles 36 and 41 refers that the freedom of opinion and expression is guaranteed, which confirms that the press exercised its full freedom within the basic elements of society to protect Freedoms. Rights and public duties and respect for the private life of citizens in accordance with the law and the Constitution. The responsibility of the press is in accordance with the provisions of the Penal Code of 1966 and the Media Act of 1990 and 2012 when the freedom of the press exceeds the limits set for it. Thus. The Algerian legislator has committed certain acts that constitute violations of press freedom. The legislator has put a balance of guardianship Opinion and expression on the one hand, and the prohibition of harming others unlawfully, on the other.
