الرقابة على شرعية الحبس المؤقت

Résumé: الحبس المؤقت إجراء ماس بحرية الأفراد، مما جعل شرعيته تتوقف على الضمانات الفعالة التي أحاطه القانون بها، و التي تضمن حماية لهذه الحرية وتدعيما لقرينة البراءة التي يفترض أن يتمتع بها كل فرد، لذا سعى المشرع الجزائري في سبيل حماية هذه الضمانات نفسها من خطر الاعتداء عليها إلى أن تكون الرقابة الممارسة على شرعية الحبس المؤقت من قبل الجهات التي خول لها هذه الصلاحية كون الرقابة تعد وسيلة للحد من تعسف السلطة المختصة بإصدار الحبس المؤقت، بحيث تؤمن أن يكون هذا الإجراء موافقا للشروط والمبررات التي تجعل منه إجراءا قائما على أسس قانونية و منطقية، ومن ثمة تبيان مشروعيته. Temporary imprisonment is a procedure that violates the freedom of individuals, which made its legitimacy dependent on the effective safeguards surrounded by law, which ensure the strengthening of the presumption of innocence that each individual is supposed to enjoy. Therefore, in order to protect these same guarantees from the risk of abuse, the Algerian legislator sought to monitor the legality of temporary detention by the authorities that were granted this authority, as supervision is a means to limit the arbitrariness of the competent authority in its issuance, to ensure that this procedure meets the conditions. And the justifications that make it a legal and logical procedure that proves its legitimacy.
