Résumé: الملخص: يفرض المشرع الجزائري في المرسوم التشريعي رقم 93-10 أن يتم التعامل في البورصة عن طريق وسيط مالي، وإلاّ بطلان التداول، غير أن بعض الوسطاء يستغلون هذا التكليف التشريعي لممارسة بعض الجرائم التي تمس بالمستثرين في البورصة وبالاقتصاد الوطني، ونظرا لتزايد عدد القضايا بشكل مضطرد نوعيا وكميا خلال العقد الأخير من القرن الحالي، فيتطلب الفصل في الجرائم المرتكبة في البورصة عموما إلى قضاة متخصصين ومؤهلين تأهيلا علميا وقانونيا في مجال البورصة، حتى يتمكنوا من تحقيق العدالة المرجوة فيما يعرض عليهم من منازاعات ناشئة عن عمليات التداول في البورصة، والتي تتسم بطبيعة فنية معقدة، فنتساءل في الدراسة التالية عن القضاء المتخصص للنظر في منازعات تداول الوسيط في البورصة؟ وماهي سلطات القضاء الجزائري على المستوى الوطني والعالمي لقمع جرائم الوسيط في البورصة؟ وماهي الإجراءات المقررة قانونا أمام المستثمرين المتضررين من جرائم الوسيط المالي؟. الكلمات المفتاحية: البورصة- الوسيط المالي-القضاء-الرقابة القضائية-لجنة تنظيم عمليات البورصة. Abstract: The Algerian legislator imposes, in Legislative Decree No. 93-10, dealing in the stock exchange through a financial intermediary under pain of nullity. However, some brokers are taking advantage of this legislative mandate to commit some crimes that affect the stock market and the national economy. The number of cases has also increased steadily and qualitatively during the last decade of this century, and the crimes committed in the stock exchange are decided in general to specialized judges who are scientifically and legally qualified in the field of the stock exchange, as they can achieve the desired justice in the disputes arising from trading in the stock exchange, so we tried in the study The following is the knowledge of the bodies specialized in looking into disputes in the judiciary of the trading of the stock broker? What are the powers of the Algerian judiciary locally and internationally to suppress the crimes of the stockbroker?
