انعكاسات مجلة الأحكام العدلية على السلطة القضائية في أواخر عهد الدولة العثمانية///the Implications Of The Majallat Al-ahkam Al-adaliyyah (the Ottoman Civil Code) On The Judiciary In The Late Ottoman Empire

Résumé: تسعى هذه الدراسة إلى بيان أثر مجلة الأحكام العدلية على السلطة القضائية مما ينتج فرقًا بين نظام القضاء قبل المجلة وبين نظام القضاء الذي اكتمل بعد تطبيق المجلة، وكذلك إلى ترشيد علاقة المجلة بالمؤسسات التي تشكل السلطة القضائية في الدولة العثمانية، وأيضًا إلى بيان دور المجلة في تحديد مهام السلطة القضائية. واعتمدت الدراسة على المنهج الاستقرائي بخريج المواد المنظمة للسلطة القضائية وعلى المنهج الوصفي التحليلي في التعبير عن علاقة المجلة بالسلطة القضائية بشكل يساهم في فهمها من خلال الرجوع إلى شروح المجلة، والوثائق التاريخية. وخلصت الدراسة إلى معرفة دور المجلة في السلطة القضائية والذي يتضمن تشكيل نظام المحاكم النظامية، وتأسيس الانسجام فيما بينها وإحقاق العدالة من حيث ضبط المجلة مهام السلطة القضائية برصد موادها فيها، وإلى التوصيات التي ينبغي أن تأخذ بعين الاعتبار لاستفادة المؤسسات القضائية من هذه التجربة الأولية. Abstract: This paper seeks to clarify the impact of Majallat al-Ahkam al-Adaliyyah on the judicial system. It will compare the pre-Majallah judicial system with the post-Majallah judicial system, and seek to establish its relationship with the different institutions that constituted the judicial authority within the Ottoman Empire. Additionally, it will clarify the role of the Majallah in determining the various functions of the state’s judicial institutions.The study utilizes the inductive methodology in deriving the various articles of law from the Majallah. It also utilizes the descriptive/analytical approach by referencing historical documents and commentary on the Majallah that express its relationship with the judicial authority. The study concludes that the Majallah had several roles within the judicial system. These roles include forming the court system, establishing harmony between the courts, and establishing justice by controlling functions of the judicial authority by monitoring its articles. The paper also makes several recommendations to modern judicial institutions based on its findings.
