سلطة تأديب الزوجة - دراسة مقارنة -

Résumé: تأديب الزوجة حق قررته الشريعة الإسلامية والقانون للزوج، له استعماله في حالة نشوز الزوجة، وهذا من أجل صلاحها، وللمحافظة على الأسرة من التفكك، وعلى الرجل استعمال هذا الحق وفق الشروط والضوابط التي بينها الفقهاء، وهذا حتى يتحقق الهدف الذي شرع من أجله. ويعتبر الضرب وسيلة من وسائل التأديب، غير أنه يُفضل عدم استعماله، وإذا تعسف الزوج فيه أو استعمله دون وجه حق، فللزوجة عندها مسألته قضائيا. Correcting and disciplining of the wife is a right that was decided by the Islamic legislation and the law for the husband. The husband can use this right in the case of the disobedience of his wife for her correction , and to save the family from separation and dissociation. The husband should use this right according to the conditions set by the Islamic jurists to achieve the objective made to this right.
