في ظل تغير المناخ: التقاضي المناخي ضرورة لا خيار

Résumé: مع تزايد التحديات البيئية التي تهدد الكوكب، بدءا من تغير المناخ وتدهور التنوع البيولوجي وصولا إلى التلوث واستنزاف الموارد الطبيعية، أصبح التقاضي المناخي أحد الأدوات القانونية الأساسية لمواجهة هذه الأزمات. يمثل هذا النوع من التقاضي وسيلة فعالة لضمان مساءلة الأطراف المسؤولة عن الأضرار البيئية وتعزيز الالتزام بالقوانين الوطنية والاتفاقيات الدولية. يتنوع التقاضي المناخي ليشمل قضايا التلوث، وحماية الموارد الطبيعية، ومكافحة تغير المناخ، بالإضافة إلى الدفاع عن حقوق الإنسان البيئية. ورغم دوره الحيوي، يواجه هذا المجال تحديات قانونية وإجرائية تتطلب تعزيز البنية التشريعية ودعم الأطر المؤسسية لضمان تحقيق العدالة البيئية وحماية حقوق الأجيال الحالية والمستقبلية. With the increasing environmental challenges threatening the planet, ranging from climate change and biodiversity degradation to pollution and depletion of natural resources, climate litigation has become one of the key legal tools to address these crises. This type of litigation serves as an effective means of ensuring accountability for those responsible for environmental damage and promoting compliance with national laws and international agreements. Environmental litigation encompasses a variety of issues, including pollution, the protection of natural resources, combating climate change, and defending environmental human rights. Despite its vital role, this field faces legal and procedural challenges that require strengthening the legislative framework and supporting institutional structures to ensure environmental justice and the protection of the rights of both current and future generations.
