حماية الدائن المرّتهن في رهن المنقول دون تجريد المدين الراهن من الحيازة

Résumé: الملخص: اعترف المشرع الجزائري، بالحماية للدائن المرتهن في رهن المنقول دون تجريد المدين الراهن من الحيازة، و ضمن له حق التتبع و حق الأولوية، فقد استعاض عن فكرة انتقال الحيازة للدائن المرتهن، بشأن نفاذ حقه في الرهن اتجاه الغير، و ممارسة حق التتبع، بمسألة شهر الحقوق المثقلة بالرهن، لكي يعطّل بها قاعدة الحيازة في المنقول سند الملكية، أما بصدد حق الأولوية، فإن ثبوت حق الدائن المرتهن في الأولوية مرتبط بأسبقية تاريخ قيده، حسب نوع كل رهن.Abstract : the algerian ligislator has recognized The Protection of a bonded creditor in a movable mortgage without stripping the Mortgager debtor of possession, and to guarantee the right in a traceability , and the right priority, through replacing the idea of transfer of dispossession to the bonded creditor, to oppose for others, and exrcise the right traceability, by establishing the advertising publicity of right, for obstacle the rule possession with good will of prossessor, and the right priority , the bonded creditor right, related to the superiority of date transcription, according to all the types of gage.
