التصريح بعدم تدخل مجلس المنافسة في القانون الجزائري

Résumé: نحاول من خلال هذا المقال توضيح المقاربة القانونية للتصريح بعدم التدخل أو بما يعرف في فقه المنافسة بـ" شهادة السلبية " بإعتباره سند وقائي متى تعلق الأمر بالإتفاقات أو وضعيات الهيمنة على السوق دون باقي الممارسات المقيدة للمنافسة، بما يتوافق وأحكام المرسوم التنفيذي رقم 05-175 المؤرخ في 12 ماي 2005 المحدد لكيفيات التصريح بعدم التدخل بخصوص الإتفاقات ووضعية الهيمنة على السوق التي جاءت تطبيقا لأحكام المادة رقم 8 من الأمر رقم 03-03 المؤرخ في 19 جويلية 2003 المتعلق بقانون المنافسة المعدل والمتمم. Abstract: Through this article we are trying to clarify the legal approach to the declaration of non-interference or what is known in the concurrence jurisprudence as «negative Certificate» as a protective document when it comes to agreements or position of market dominance without the rest of the practices restricting concurrence, in accordance with the provision of excutive Decree No.05-175 dated May 12, 2005 specifying the modlities of declaring non-interference in relation to agreements and the position of market dominance that came in implimentation of the provisions of the article 8 of ordinance N 03-03 OF July 19 , 2003 relating to the amended and supplemented competition law. key words: Declaration of non- interference, protective document, economic agreements, position dominanace, council conccurence, establishment of.
