Résumé: المعالجة الاجتماعية والقانونية للوقاية من العنف في المنشآت الرياضية Social and Legal Treatment for the Prevention of Violence in Sports Facilities الدكتورة لعروي زواوية جامعة جيلالي ليابس -سيدي بلعباس رقم الهاتف: 0655242325 البريد الالكتروني: [email protected] الملخص: تمثل الرياضة لغة تواصل بين كل الحضارات والأجناس فهي لغة لا تؤمن بالحدود ولا بالفوارق الاجتماعية وتساهم في مواجهة الظواهر السلبية في المجتمع، إلا أن الممارسة الرياضية في المنشآت الرياضية قد تفقد هذا الدور الاجتماعي والإنساني عندما ترتبط بظاهرة العنف في المنشآت الرياضية والذي يشكل تهديدا للأفراد والممتلكات العمومية والخاصة، هذا العنف الرياضي مشكلة لها عدة جوانب متعددة وجذور اجتماعية تستوجب معالجة على أكثر من صعيد، وعلى مستوى عدة قطاعات في المجتمع وهذا في وقت واحد لتحقيق تنمية الوعي الرياضي. ومن بين هذه القطاعات نجد المؤسسات الاجتماعية والتي تلعب دورا اجتماعيا فعالا في كبح جماح العنف ونزعاته عند الأفراد، والاعتماد على دور الأسرة باعتبارها الخلية والنواة الأولى لبناء المجتمع من خلال غرس قيم وسلوكيات مثالية في التشجيع الرياضي المنضبط، وبين المؤسسات التعليمية كالمدارس التي تحقق الوعي الرياضي من خلال الأنشطة الرياضية المدرسية المختلفة، بالإضافة إلى دور الأندية الرياضية كمؤسسة رياضية تربوية تساهم في إثراء العلاقات الاجتماعية، وتلقين المبادئ الرياضية، ودعم عملية الاتصال والتفاعل بين الأعضاء المنتسبين للنادي وأنصاره ومشجعيه. إضافة إلى هذا كله، لابد من التركيز على أهم الحلول والتدابير القانونية من قبل الهيئات الرسمية في مواجهة هذه الآفة، لذا كان لزاما على كل دولة إقرار ترسانة من القوانين التي تجرم هذه الأفعال، وترصد لها من العقوبات المختلفة سواء في القانون الجنائي أو في التشريع الرياضي، ما يساهم في الحد والوقاية من هذه الظاهرة. ونسعى من خلال تناولنا لهذا الموضوع إلى تحقيق الهدف الأسمى للممارسة الرياضية كلغة تواصل سلمية وصحية بدلا من لغة العنف، والتعرف على الحلول والآليات الاجتماعية والضوابط القانونية التي من شأنها الوقاية والحد من العنف في الوسط الرياضي. الكلمات المفتاحية: معالجة قانونية واجتماعية ـ ـــــ وقاية ـــــ منشآت رياضية ـــــ عنف رياضي. Abstract : Sport represents a universal language of communication transcending civilizations and races. It disregards borders and social differences, contributing to the confrontation of negative phenomena in society. However, the practice of sports in sports facilities may lose its social and humanitarian role when it becomes associated with the phenomenon of violence, which poses a threat to individuals and public property. Sports violence is a multifaceted problem with social roots that necessitate treatment on multiple levels, involving various sectors of society, all while striving to develop sports awareness. These sectors include social institutions that play a crucial role in curbing violence and its tendencies among individuals. The family, as the fundamental unit of society, instils ideal values and behaviours, fostering a culture of disciplined sports. and among educational institutions such as schools that achieve sports awareness through Through various school sports activities, in addition to the role of sports clubs as an educational sports institution that contributes to enriching social relations, teaching sports principles, and supporting the process of communication and interaction between club members, supporters and fans. In addition to all this, it is necessary to focus on the most important solutions and legal measures by official bodies in the face of this scourge, so it was necessary for each country to adopt an arsenal of laws that criminalize these acts, and monitor them from various penalties, whether in criminal law or in sports legislation. , which contributes to the reduction and prevention of this phenomenon. Through our discussion of this topic, we seek to achieve the ultimate goal of sports practice as a peaceful and healthy language of communication instead of the language of violence and to identify solutions, social mechanisms and legal controls that prevent and reduce violence in the sports community.
