الحماية القانونية لحرية المعتقد وممارسة الشعائر الدينية بكل حرية في التشريع الجزائري

Résumé: تعتبر حرية ممارسة العبادة في أماكنها المخصصة مظهرا من مظاهر الممارسة الدستورية للحقوق والحريات الأساسية التي يكفلها الدستور الجزائري لكل مواطن مقيم على أرض الجزائر، هذه الحرية التي تكفلها أيضا التشريعات القانونية ذات الصلة، والتي تتطلب بالضرورة حماية الأماكن المخصصة لممارسة الشعائر الدينية للمسلمين فضلا عن غيرهم، وموقف المشرع الجزائري بأن في إطار التزامات الجزائر بالمعاهدات والاتفاقيات الدولية التي تنص على حماية حرية المعتقد وممارسة العبادة، وهذا قد أحاط المشرع الجزائري أماكن العبادة لمختلف الأديان بالحماية الجزائية من أشكال الاعتداء وذلك من خلال نصوص قانون العقوبات والنصوص المكملة له، هذه الحماية تنفرد لدور العبادة باعتبارها ملكية تمارس وظيفة عقائدية، ومن جهة أخرى من منطق حفظ النظام العام الذي يتطلب تحقيق الاستقرار والسكينة العامة، ومن خلال هذا البحث نحاول توضيح الغاية التي يستهدفها المشرع الجزائري من وراء إقرار هذه الحماية الجزائية. الكلمات المفتاحية: حرية المعتقد، الدين، أماكن العبادة، الحماية الجزائية، الشعائر الدينية. Summary: The freedom to practice worship in its designated places is a manifestation of the constitutional practice of the fundamental rights and freedoms guaranteed by the Algerian constitution to every citizen residing on the territory of Algeria, this freedom is also guaranteed by the relevant legal legislation, which necessarily requires the protection of places designated for the practice of religious rites for Muslims as well as Others, and the position of the Algerian legislator that within the framework of Algeria's obligations with international treaties and conventions that provide for the protection of freedom of belief and the practice of worship, and this Algerian legislator has surrounded places of worship of different religions with penal protection from forms of abuse and that through the provisions of the penal code and supplementary texts For him, this protection is unique to places of worship as a property that exercises an ideological function, and on the other hand from the logic of preserving public order that requires the achievement of stability and public tranquility, and through this research we try to clarify the goal that the Algerian legislator aims to establish behind this penal protection. key words: Freedom of belief, religion, places of worship, penal protection, and religious rites.
