آليات تسوية العقار الفلاحي محل الاستصلاح في إطار ترقية الاستثمار في الجزائر

Résumé: نتناول في بحثنا هذا، الآليات القانونية لتطهير العقار الفلاحي المستغل عن طريق الاستصلاح في إطار ترقية الاستثمار في الجزائر، و فيه نقوم بتحليل إجراءات تسوية العقارات الفلاحية موضوع الاستصلاح في إطار القانون 83/18 المؤرخ في 13/08/1983 المتعلق بحيازة الملكية العقارية الفلاحية، و كذا إجراءات تطهير العقار الفلاحي الممنوح في إطار ترقية الاستثمار، و ذلك على ضوء المنشور الوزاري المشترك رقم 750 المؤرخ في 18/07/2018 المتعلق بتطهير العقار الفلاحي . و في النهاية، سنحاول تحديد مدى فعالية النصوص القانونية المنظمة لهذه الإجراءات، و ذلك بغرض محاولة تقديم اقتراحات لإدخال تعديلات على الإطار التشريعي و التنظيمي الساري المفعول، المتعلق بتسوية العقار الفلاحي موضوع الاستصلاح في إطار الاستثمار. ABSTRACT In this research we’re discussing the legal mechanisms relating to the regularization of agricultural land in the framework of the promotion of investment, in Algeria, and in it we try to analyze the modalities and the procedures of regularization of the agricultural lands to be reclaimed, in the framework of the law n ° 83/18 of 13/08/1983 relating to the possession of agricultural land ownership , as well as those procedures and modalities for the regularization of the agricultural land attributed within the framework of the investment, according to the interministerial circular No 750 of 18/07/2018. Finally, we will try to determine the effectiveness of those procedures, with the aim of bring out the suggestions that must be submitted to the legislation .and regulations in effect, relating to the settlement of agricultural lands that are the subject of reclamation in the framework of the investment RÉSUME Dans cette recherche ; nous traitons les mécanismes juridiques relative à la régularisation du foncier agricole dans le cadre de la promotion de l’investissement, en Algérie, et dedans on tente d’analyser les modalités et les procédures de régularisation des terres agricoles à mettre en valeur dans le cadre de la lois n° 83/18 du 13/08/1983 relative à l’accession à la propriété foncière agricole, ainsi que celles de l’assainissement du foncier agricole attribué dans le cadre de l’investissement, selon la circulaire interministérielle n° 750 du 18/07/2018 . Enfin, nous essaierons de déterminer l’efficacité de ces procédures, dans le but de ressortir les suggestions que doit subir la législation et la réglementation en vigueur, relative à l’assainissement du foncier agricole faisait l’objet de la mise en valeur dans le cadre de l’investissement.
