تفعيل قواعد المقاصد في الفقه النوازلي، زواج المسيار أنموذجا.

Résumé: ازدادت مظاهر الحرص على مقاصد الشريعة الإسلامية عند الأصوليين من خلال السعي إلى ضبطها بالقواعد المؤطِرة لها، هذه المقاصد هي التي تكشف بدقة عن الحكم الشرعي المقصود من النص الشرعي؛ كما أنّ القواعد الجامعة في أي علم من العلوم – ومنها علم مقاصد الشريعة- هي الأساس الذي تقوم عليه مباحثه، و الرباط الذي يشدُّ مسائله، حتى قال العلماء :"إنّ ضبط الأمور المنتشرة المتعدّدة في القوانين المتّحدة هو أوعى لحفظها وأدعى لضبطها"، قلت لمّا كانت القواعد بهذه المكانة الكبرى والأهميَّة العظمى بات مسلَّما أنّ البحث الذي يتّجه إلى دراستها وتحليلها هو بحث في غاية الأهميَّة؛ لأنّه ينحو منحى الكليات . إنّ معرفة الناظر في النوازل لمقاصد الشريعة يعينه على معرفة أحكامها؛ ولذلك كان الفقيه الذي يتصدى لدراسة النوازل في أمس الحاجة إلى مراعاة قواعد المقاصد عند فهم النصوص؛ لتطبيقها على الوقائع الحادثة، وإلحاق حكمها بالنوازل والمستجدات The purposes of Islamic Shari'a have been increased by the fundamentalists by seeking to control them by the rules that underlie them.
