مكافحة الفساد عبر اليات الرقابة على المنح المؤقت للصفقة العمومية

Résumé: الملخص: أنشأ المشرع الجزائري آليات عدة لمكافحة الفساد في الصفقات العمومية خاصة بعد المنح المؤقت للصفقة،وذلك انطلاقا من اعتبارها أهم الآليات التعاقدية التي تراهن عليها الدولة من أجل تحقيق تنمية اقتصادية واجتماعية،وكذا قفزة نوعية في كل المجالات وذلك لاعتبارها أكبر القنوات المستهلكة للمال العام لذا فقد أحاطها المشرع من خلال المرسوم الرئاسي 15/247 بكافة الضمانات القانونية لضمان الشفافية والنجاعة وتحقيق مبدأ المساواة،وذلك من خلال اعتماد العديد من أدوات الرقابة خاصة بعد المنح المؤقت للصفقة لما لها من أهمية بالغة في كشف الفساد التلاعب بالمال العام. Abstract: Algerian legislation has established several mechanisms to combat corruption in public transactions, especially after the temporary grant of the transaction, based on the fact that it is considered to be the most important contractual mechanisms the State wishes for economic and social development, as well as a qualitative leap in all fields, as it is the largest consumer channel Therefore, through Presidential Decree No. 15/247, the legislator informed it of all legal safeguards to ensure transparency and efficiency and achieve the principle of equality, through the adoption of a number of monitoring tools, especially after the interim grant of the transaction, which is crucial for the detection of corruption .and manipulation of public money
