التقاضي في البيئة الرقمية بين ضمان السرعة في الإجراءات وتجاوز ضمانات المحاكمة العادلة

Résumé: أدى التطور العلمي والتكنولوجي إلى اخضاع قطاع العدالة لحتمية مواكبته، وهذا من خلال إدخال الرقمنة على الإجراءات القضائية، في إطار ما يعرف بالتقاضي الإلكتروني قصد محاولة اختصار إجراءات التقاضي وتسريع الدعوى العمومية. يعتبر هذا النظام بالغ الأهمية، اذ يوفر العديد من المزايا للمتقاضين دون تمييز، لعل أهمها السرعة في الإجراءات وتقليل النفقات وتقديم طلباتهم وإرفاق جميع المستندات إلكترونيًا دون الحاجة للحضور الشخصي للمحكمة، مما يساهم في تسريع وتيرة التقاضي. بغض النظر عن المزايا التي يوفرها التقاضي عن بعد، إلا أنه يفرض العديد من المخاوف و التحديات اتجاه الضمانات الممنوحة للمتقاضيين، الأمر الذي يستوجب ضرورة الموازنة بين هاته الضمانات وبين كيفية استعمال هذه التقنية في إطار تسريع إجراءات التقاضي على المستوى الجزائي. The scientific and technological development has led to the necessity of keeping pace with the justice sector, through the introduction of digitization into judicial procedures, within the framework of what is known as electronic litigation, in an attempt to shorten litigation procedures and expedite public lawsuits. This system is of utmost importance, as it provides many advantages to litigants without discrimination, perhaps the most important of which are the speed of procedures, the reduction of expenses, and the submission of their requests and the attachment of all documents electronically without the need for personal appearance before the court, which contributes to accelerating the pace of litigation. Regardless of the advantages provided by remote litigation, it imposes many concerns and challenges towards the guarantees granted to litigants, which necessitates the need to balance these guarantees and the way of using this technology within the framework of accelerating litigation procedures at the criminal level.
