التمييز الايجابي لصالح المرأة في مجال الوظيفة و الاستخدام

Résumé: ملخص : إن النهوض بوضعية المرأة و تحسين مكانتها في المجتمع ، وتحقيق مساواتها مع الرجل و مكافحة التمييز الممارس ضدها، كان و مايزال يشكل انشغالا أساسيا للمجتمع الدولي ككل و المشرع العمّالي الدولي و الوطني بالخصوص . فإذا كان مبدأ المساواة في المعاملة و الذي بموجبه يعامل كل شخص معاملة مماثلة لتلك التي يعامل وفقا لها شخص آخر يتواجد في مركز مماثل، يعّد واحد من المبادئ التي أقرتها التشريعات و المواثيق الدولية و الوطنية رغبة منها في تحقيق أكبر قدر ممكن من العدالة في مجال التوظيف و العمل ، فان المساواة في الفرص هي هدف و غاية يرجى تحقيقها عن طريق تدابير التمييز الايجابي. و باعتبار الجزائر ملزمة بتطبيق التزاماتها الدولية في هذا الخصوص تماشيا مع منظومة حقوق الإنسان ، فقد كرس التعديل الدستوري لسنة 2016 إجراءات ايجابية لصالح المرأة في مجال الالتحاق بالعمل و الوظيفة انسجاما مع ما تضمنته الاتفاقيات الدولية في هذا المجال. الكلمات المفتاحية: المناصفة-ترقية المرأة-التمييز الايجابي-مساواة الفرص-الاستخدام-الوظيفة. Summary : The rise and the improvement of women status in society,their realization of equality with men,and the fight of sexism against women,still remain a major concern in the international civil society in general and in the national and international labour legislator in particular The principle of equal treatment in which each person is treated equally to another person in the same position is generally considered as one of the adopted principles by national and international laws and legislations in oder to achieve as much justice and equality as possible in the work and employment field, The equality of opportunities is considered as an aim that has to be achieved through the positive discrimination arrangements Regarding that Algeria is obliged to appl its international commitments in this field in accordance with the human right’s system, the constitutional amendment in 2016 has established positive arrangements in the work and employment field for the benefit of women, in harmony with international conventions .
