السيادة بين نظريتي الامة والشعب

Résumé: كرست الديمقراطية المباشرة الصورة المثلى لمفهوم ممارسة سيادة الشعب ، ولكن صعوبة تحقيقها بعد تطور وظائف الدولة ، تطلب تطبيق نظام آخر يدعى الديمقراطية غير المباشرة، حيث يقوم الشعب بممارسة سيادته بانتخاب ممثلين له لتولي شؤون الحكم بالارادة المسندة لسلطات الدولة في اطار الدستور والقانون باسم صاحب السيادة الفعلي، من خلال نظرية سيادة الأمة ونظرية سيادة الشعب امام خاصية السيادة التي ترتب تساوي الدول قانونا في المجتمع الدولي، وسنحاول بالمقال بحث مدلول نظريتي الامة والشعب على ممارسة سيادة الافراد داخل الدولة. Direct democracy devoted the best picture to the concept of the exercise of the sovereignty of the people, but the difficulty of achieving it after the development of the functions of the State required the application of another system called indirect democracy, in which the people exercised their sovereignty by electing their representatives to govern by the will of the State authorities under the Constitution and the law in the name of the de facto sovereign. Through the theory of the sovereignty of the nation and the theory of the sovereignty of the people in front of the sovereignty characteristic which entails the legal equality of States in the international community, we will try to discuss the meaning of the theories of the nation and the people on the exercise of the sovereignty of individuals within the State
