المنظور التشاركي في ارساء دولة الحق و القانون

Résumé: تبحث هذه الورقة البحثية في الجدلية المتعلقة بين الفعل القانوني والممارسة الديموقراطية، هذه العلاقة تجد وجودها ضمن مبادئ أساسية لدولة الحق والقانون، وتتشكل معها المقاربة التشاركية لفعاليات المجتمع المدني ذات بعد عميق وكفاعل أساسي للديموقراطية باعتبارها قيمة ذات أولوية تسعى من خلالها الدول الى تكريسها في إطار سيادة القانون تطبيقا لمبدأ المساواة دون أي ما تمييز. يهدف هذا البحث الى دراسة مسألة التأسيس لهذا الطرح من خلال تطبيق هذه المقاربة، نتلمس أن المقاربة التشاركية هي ضامن حقيقي في إرساء دولة الحق والقانون وبناء علاقة تكاملية مبنية على لعب كل طرف لأدواره المنوطة به. Abstract: This research paper explores the dialectical relationship between legal action and democratic practice, this relationship finds its foundation within the fundamental principles of the rule of law and is closely linked to the participatory approach of civil society actors, who play a crucial role in democracy as a fundamental value. States strive to uphold this value within the framework of the rule of law, ensuring the application of the principle of equality without discrimination. The objective of this study is to examine the establishment of this approach through its practical application. We find that the participatory approach serves as a true guarantor for the consolidation of the rule of law, fostering a complementary relationship in which each party fulfills its assigned roles.
