حسن النية وأثره على الحق في الضمان في بعض العقود

Résumé: ملخص: مما لا شك فيه أن لمبدأ حسن النية أهمية كبيرة وعظيمة إعتد بها المشرع ورتب عليها آثار مهمة في حالة توافر حسن نية طرفي العقد أو عدم توافرها وذلك من حيث الآثار التي تترتب على العقد، كما يتضح من خلال تفحص مضمون نصوص القانون المدني أن المشرع الجزائري قد آثار مسألة الغش في كثير من المرات عند تحديده لالتزامات المتعاقدين، خصوصا إذا ما تعلق الأمر بالإلتزام بالضمان.حيث يلعب حسن النية دورا هاما في انشاء وترتيب اثار المراكز القانونية في القانون الوضعي .كما يعتبر الالتزام بالضمان من اهم الالتزامات التي ترتبط بحسن النية وتعتبر مظهرا له والالتزام بالضمان يتسع مداه كل ماكان العقد يقوم على ترابط المصالح بين الطرفين Abstract: Undoubtedly, the principle of good faith is of great importance to the legislator and has important implications in the case of the good will of the parties to the contract or not, in terms of the implications of the contract, as shown by examining the content of the provisions of the Civil Code that the Algerian legislator has The effects of the fraud issue are many times when determining the obligations of contractors, especially when it comes to the obligation to guarantee.
