الالتزام بالضمان في ظل قانون حماية المستهلك وقمع الغش الجزائري

Résumé: واكبت الجزائر كغيرها من دول العالم الحركية التشريعية في مجال حماية المستهلك خاصة مع تبنيها للإقتصاد الحر وتحرير التجارة، مما نتج عنه تطور أنماط وحجم الاستهلاك وبالتالي ازدياد المخاطر التي تهدد المستهلك. يعتبر الإلتزام بالضمان من أهم المواضيع التي جاء بها المشرع حيث يعتبر المتدخل ذو مركز قوي أمام المستهلك الذي يعتبر حلقة ضعيفة، الأمر الذي دعى إلى توفير الحماية للمستهلك أثناء قيامه بالمعاملات التجارية، بحيث جعل للمستهلك الحق في الرجوع على البائع عند إخلاله بالتزامه بالضمان عن طريق دعوى الضمان في حالة ما إذا كان المبيع غير صالح للانتفاع به من طرف المستهلك أو كان به عيبا جسيما غير قابل للإصلاح وبلوغه درجة من الخطورة تجعله غير قابل للاستعمال جزئيا أو كليا، ففي هذه الحالة يحق للمستهلك المطالبة بالتعويض عن كل الأضرار الناجمة عن المنتوج المتوقعة وغير المتوقعة، وعلى المتدخل تنفيذ التزامه بالضمان حسب الترتيب الوارد في المادة 13 من قانون حماية المستهلك وقمع الغش أن يقوم إما بإصلاح المبيع أو استبداله أو رد الثمن . إن الالتزام بالضمان هو التزام بتحقيق نتيجة لذلك يسعى المشرع من خلال النصوص القانونية والأحكام إلى خلق مبدأ التوازن بين المتدخل والمستهلك للحفاظ على استقرار المعاملات. الكلمات المفتاحية : حماية المستهلك، التزام المتدخل بالضمان، دعوى الضمان، مسؤولية المتدخل.
