دراسة قانونية لشكل الإعانات المالية الممنوحة للجمعيات من طرف الدولة والجماعات المحلية A Legal Study Of The Form Of Subsidies Granted To Associations By The State And Local Communities

Résumé: يطرح موضوع تمويل الجمعيات في النظم القانونية مجال كبير في الدراسات القانونية والاجتماعية والاقتصادية لما تتمتع به الجمعيات من دور كبير و حساس في المجتمعات البشرية، فقد حدد المشرع الجزائري شروط و إجراءات من أجل أن تتحصل الجمعيات على إعانات من الدول أو أحد هيئاتها العمومية، هذه الشروط التي تعتبر من جهة حق للدولة من أجل ضمان عدم تبذير هذه الأموال، ومن جهة أخرى يخشى من السلطة التقديرية التي تتمتع بها السلطات الوصية في منح أو عدم منح هذه الإعانة، مع العلم أن المشرع أخضع الجمعيات التي تحصلت على الإعانات المالية من قبل الدولة لأنواع مختلفة من الرقابة، منها رقابة المفتشية العامة للمالية و رقابة مجلس المحاسبة، فمن خلال هذه الدراسة يستنج أن المشرع و هذه الهيئات وضعت شروط مختلفة و متنوعة من أجل منح دعم مالي للجمعيات الخيرية ولكن كان على المشرع أن يمنح للجمعيات وسائل ضغط على هذه الهيئات كي تسرع في هذه الاجراءات و تضمن عدم لجوء هذه السلطات إلى وسائل البيروقراطية. Summary: The subject of funding associations in legal systems is a great field in legal, social and economic studies because of the great and sensitive role of associations in the human societies. The Algerian legislator has set forth conditions and procedures in order for associations to receive subsidies from States or one of its public bodies, These conditions, which are considered to be the right of the State to ensure that these funds are not wasted, and on the other hand, fear the discretionary power enjoyed by the authorities to grant or not to grant such a subsidy. The legislator subjected associations that received subsidies by the State For different types of slavery Including the supervision of the General Inspectorate of Finance and the Audit of the Accounting Council. It is evident from this study that the legislator and these bodies set different and varied conditions in order to grant financial support to charities. However, the legislator should grant the associations pressure on these bodies to speed up these And ensure that these authorities do not resort to bureaucratic means.
