أثر اتفاقية تريبس في تعزيز نقل التكنولوجيا الدوائية إلى الدول النامية وفقا لإعلان الدوحة

Résumé: مـلخـص: إن مسألة توفير التكنولوجيا أصبح ضرورة حتمية للدول النامية، حتى تستطيع مجابهة احتكار الدول المتقدمة لها، وفي هذا الصدد أصبحت قضية الحصول على التكنولوجيا الطبية والدواء مسألة توتر شديد خاصة بعد أن سطرت اتفاقية تريبس مسألة حماية هذه التكنولوجيا بموجب براءات الاختراع، فضلا عن عيوب أحكام هذه الاتفاقية التي تعنى بمسألة حماية حقوق الملكية الفكرية على مصالح الدول النامية، مما أدى بهذه الأخيرة وخاصة بعد تفاقم الأمراض وصعوبة الحصول على الدواء، إلى توحيد موقفها بمساندة المنظمة العالمية للصحة إلى عقد المؤتمر الوزاري المتعلق بهذا الشأن أو ما يعرف بإعلان الدوحة للتنمية، من أجل توسيع فرص المرونة خاصة في مجال براءات فيما يتعلق بإنتاج وتصنيع الدواء ونقل التكنولوجيا المتعلقة به. Abstract : The issue of the provision of technology has become a necessity for developing countries sothattheycancounter the monopoly of developed countries. In this regard, the issue of access to medicaltechnology and medicine has become a matter of great tension, especiallyafter the TRIPS Agreement established the protection of thistechnologyunder patents. Which deals with the issue of the protection of intellectualpropertyrights over the interests of developing countries, whichled the latter, especiallyafter the aggravation of diseases and the difficulty of obtainingmedicine, to uniteits position with the support of the World Organization for Health to hold the MinisterialConferenceThe so-called Doha DevelopmentDeclaration, in order to expandopportunities for flexibility, particularly in the field of patents, in the production, processing and transfer of technology.
