Résumé: ملخص: تحاول هذه الدراسة تقديم صورة عن المنهج التأويلي وذلك لما له من تأثير على فهم النصوص الشرعية فهما صحيحا، ولما له أيضا من خطورة كبيرة من جهة أخرى إن خرج عن ضوابطه ، لذلك استعان العلماء قديما وحديثا بجملة من القواعد والآليات المستمدة من التفسير، وعلوم القرآن، وعلوم الحديث وأصول الفقه، وغيرها من العلوم لفهم النصوص الشرعية. Abstract: This study attempts to present an image of the hermeneutic approach due to its impact on the right understanding of the legal texts and because of its serious effect if it goes beyond its limits. Therefore, scholars, both ancient and contemporary, use a set of rules and mechanisms derived from exegesis, Qur’anic sciences, Hadith Sciences and Usul al-fiq’h(the origins of jurisprudence) and other sciences for a better understanding of the legal texts.
