التنظيم القانوني لعمليات تحويل الجنس في دولة الامارات -دراسة مقارنة ببعض أحكام الشريعة الإسلامية

Résumé: الملخص: أدى تطور الأبحاث والتكنولوجيا إلى إحداث نقلة نوعية في علم الطب، إذ امتد مجال العمل الطبي إلى إجراء جراحات لم تكن تخطر على بال البشرية في العقود السابقة، حيث تمكن الأطباء – إلى حد معين – من إجراء عمليات تحويل الجنس، من خلال إدخال بعض التغييرات على جنس شخص ما بواسطة المعالجات الهرمونية والعمليات الجراحية، بهدف إنماء جنس معين أو إلغاؤه، وتختلف دوافع إجراء هذه العمليات من شخص لآخر، حيث أن بعض الأشخاص يجرونها لدوافع علاجية، في حين أن البعض الآخر يجرونها لدوافع غير علاجية. وقد قمنا في هذا البحث بتسليط الضوء على التنظيم القانوني لعمليات تحويل الجنس وفقاً للمرسوم بقانون اتحادي رقم (4) لسنة 2016 بشأن المسؤولية الطبية الإماراتي، مقارناً ببعض أحكام الشريعة الإسلامية، وذلك تحقيقاً للأهداف التالية: 1- معالجة الإشكالية القانونية المعاصرة الناجمة عن التقدم في مجال الطب ألا وهي عمليات تحويل الجنس. 2- رفع الوعي المجتمعي بالأحكام الشرعية والقانونية المتعلقة بالمتحولين جنسياً، نظراً لقلة الأبحاث والدراسات التي عنيت بهذا الموضوع. Abstract : The development of research and technology has led to a paradigm shift in the medical science, as the field of medical work has extended to operations that were not envisioned on human minds in previous decades; where doctors have been enabled, to a certain extent, to conduct sexuel transition , by introducing some changes to the sex of a person through hormonal treatments and surgeries, with the aim of the growth or elimination of a particular sex, and the motives of the conduction of these operations differ from one person to another, as some people conduct these operations for therapeutic reasons, while others conduct it for non-therapeutic motives. As we highlighted, the legal framework of the sexual transition accordance to the Federal Decree Law No. (4) Of 2016 on Medical Liability and compared it to some provisions of Sharia Law, in order to achieve the following objectives: 1- To resolve one of the contemporary legal problems in the medical progress in the field of sexual transition. 2. To raise the community awareness about the Sharia and legal provisions related to transgender people, due to the lack of research and studies regarding this matter.
