الإبقاء على العقد

Résumé: لقد منح المشرع الجزائري في القانون المدني للقاضي والمتعاقدين الحق في تعديل العقد و المساس به و ذلك بهدف المحافظة على العلاقة التعاقدية قائمة وضمان إستمرارها و استقرا المراكز التعاقدية و ضمان الأمن التعاقدي ،فعلى الرغم من أن هذا التعديل يظهر في ظاهره أنه وطأ للمبادئ التقليدية كمبدأ القوة الملزمة و تدنيس لمبدأ سلطان الإرادة ، و تطاول على حرمة العقد و هتك بقدوسيته و تنكيس للمبادئ الكلاسيكية للعقد إلاّ أنه في فحواه تثبيت لإرادة المتعاقدين و ضمان للإستمرار العلاقة التعاقدية قائمة مما يجعل التعديل كتطبيق واضح لفكرة الإبقاء على العقد و ذلك من خلال العمل على تنفيذ العقد و ترسيخه من خلال التعديل فيه.
