التكييف القانوني لمستثمر الشيء المرهون حيازياً (دراسة مقارنة)

Résumé: الملخص إنّ تحديد صفة الدائن المرتهن عند قيامه باستثمار الشيء المرهون حيازياً يستند، إمّا الى القول بأنّ الدائن المرتهن يعد نائباً عن الراهن عندما يقوم باستثمار الشيء المرهون، فهو يمارس سلطته على الشيء المرهون كمستثمر له لحساب ولمصلحة الراهن، وليس لحسابه ومصلحته هوَ، والقول بغير ذلك يؤدي الى حصوله على فوائد ربوية غير مشروعة، لأنّ الراهن عندما يسلم المرهون الى الدائن المرتهن فإنّه يوكله وكالةً ضمنية في ادارته واستغلاله. أو أنّه أي الدائن المرتهن يعد اصيلا عن نفسه حينما يقوم باستثمار الشيء المرهون، فيقوم بالاستثمار اصيلاً عن نفسه بمقتضى سلطه يخولها اياه حقه العيني في الرهن الحيازي، باعتبار ان الراهن يتنازل بموجب عقد الرهن عن احدى سلطاته باعتباره مالكاً، وهي سلطة الاستغلال الى الدائن المرتهن، الذي يستولي بموجبها باعتباره حائزاً قانونياً لمحل الرهن على ثمار محل الرهن نظير خصم الصافي منه من اصل الدين.
