مبدأ نسبية أثر العقد و الإستثناءات الواردة عليه في القانون المدني الجزائري

Résumé: يتمحور موضوع الدراسة حول الأثر النسبي للعقد والإستثناءات الواردة عليه، ويقصد بمبدأ الأثر النسبي للعقد انصراف أثر العقد بالنسبة للأشخاص الذين أبرموا العقد وإلى خلفهم العام والخاص دون الغير، وتتجلى تلك الآثار أيضا في الإلتزامات التي كانت محل العقد دون سواه أي أن أثر العقد محصور من الناحية الشخصية والموضوعية، وهذا هو الأصل، وبما أن لكل أصل إستثناء فإن لمبدأ الأثر النسبي للعقد إستثناءات منها ما يتعلق بأشخاص العقد فتنصرف آثار العقد إلى غير عاقديه كما عليه الحال في الإشتراط لمصلحة الغير، والتعهد لمصلحة الغير، ومنها ما يتعلق بموضوع العقد كما لو استدعى ذلك ظرف طارئ، أو تعديل ونقض العقد إما بإتفاق الأطراف أو من القاضي. الكلمات المفتاحية: العقد، أثر العقد، مبدأ نسبية العقد، نسبية العقد. Abstract The subject of the study revolves around the relative effect of the contract and the exceptions contained therein, and the principle of the relative effect of the contract means that the effect of the contract will go away with respect to the people who concluded the contract and their public and private successors without third parties. Personality and objectivity, and this is the principle, and since every principle has an exception, the principle of the relative effect of the contract has exceptions, some of which are related to the persons of the contract, so the effects of the contract go to non-contractual ones, as is the case in the stipulation in the interest of others, and the undertaking in the interest of others, and some of them are related to the subject of the contract as if it was require an emergency circumstance, or the amendment and revocation of the contract, either by agreement of the arties or by the judje.
