الآليات التشريعية والمؤسساتية لتمكين المجتمع المدني من المشاركة في تحقيق التنمية المحلية

Résumé: يعد موضوع المجتمع المدني من المواضيع ذات الأهمية البالغة على الصعيد المحلي والوطني وحتى الدولي، حيث عملت التشريعات بما فيها المشرع الجزائري على وضع مجموعة من الآليات والتدابير منها التشريعية ومنها المؤسساتية، والتي تكرس دور المجتمع المدني في تحقيق التنمية المحلية، ومما لاشك فيه أن التدابير القانونية لوحدها غير كافية لوحدها بل تقتضي وجود آليات إجرائية، وهذا ما عمل على تحقيقه المشرع الجزائري من خلال التعديل الدستوري لسنة 2020، بالإضافة إلى جملة من التشريعات الأخرى، على غرار قانون البلدية والولاية وقانون الجمعيات، حيث نصت هذه التشريعات على دور المجتمع المدني في المساهمة في بناء الدولة والمشاركة في التسيير العمومي، بالإضافة إلى المشاركة في تحقيق أهداف التنمية. The subject of civil society is one of the subjects of high importance on the local, national and even international level. Indeed, the legislations including the Algerian legislator have acts on the establishment of a series of mechanisms and measures including the legislative and institutional ones which embody the role of civil society in the achievement of local development. However, legal measures alone are insufficient because they require the existence of procedural mechanisms that the Algerian legislator has attempted to achieve through the constitutional reform of 2020, in addition to a series of other legislations such as Municipal, Province and the associations law. Indeed, these legislations have provided for the role of civil society in contributing to the construction of the State and participating in public management in addition to participating in the achievement of development objectives.
