أثر جريمة التزوير على التعاقد الإلكتروني

Résumé: نتيجة لهذه التطورات التكنولوجية وما صاحبها من تطور في الكومبيوتر والاتصالات، ظهرت التجارة الالكترونية، كإحدى روافد ثورة المعلومات ، ووصلت شبكة الانترنت إلى كل منزل ومتجر وشركة، حتى غدت العمود الفقري في الدول المتقدمة للمعاملات الاقتصادية وعقد الصفقات وإبرام العقود الإلكترونية. إلا أن هذه المعاملات الإلكترونية بما فيها العقود الإلكترونية تصطدم بجملة من العوامل التي تؤثر بالسلب على هذه الأخيرة بما فيها جريمة التزوير التي تعد من جرائم الغش في مجال المعلوماتية، حيث أجد المشرع الجزائي الجزائري عديد الآليات الإجرائية والموضوعية بغية وضع حد لهذه الجريمة ، والحفاظ على الثقة بين المتعاملين واستقرار المعاملات الإكترونية، بما فيها التعاقد الإلكتروني . الكلمات المفتاحية: التعاقد الإلكتروني، جريمة التزوير الإلكتروني، جرائم الغش، الضبطية القضائية. Abstract: As a result of these technological developments and the accompanying development in computers and communications, e-commerce emerged as one of the tributaries of the information revolution, and the Internet reached every house, store and company, Until it became the backbone in developed countries for economic transactions, transactions and electronic contracts. However, these electronic transactions, including electronic contracts, collide with a number of factors that negatively affect the latter, including the crime of forgery, which is a crime of fraud in the field of informatics, where the Algerian criminal legislator found many procedural and objective mechanisms in order to put an end to this crime, and maintain trust between customers and the stability of electronic transactions, including electronic contracting.
