عقد الامتياز الفلاحي كأسلوب جديد لترقية الاستثمار في الجزائر

Résumé: يعتبر موضوع عقد الامتياز الفلاحي من أهم المواضيع التي تساهم في ترقية الاستثمار في الجزائر، وهذا ما دفع المشرع الجزائري إلى تنظيمه، سواء من حيث أطراف عقد الامتياز سواء كانوا مستفيدين من عقد الامتياز، أو كانت الدولة بصفتها مانحة لعقد الامتياز . بالإضافة إلى ذلك سعى المشرع الجزائري إلى تنظيم أحكام عقد الامتياز الفلاحي سواء من حيث موضوع عقد الامتياز والمتمثل في منح الأراضي التابعة للأملاك الوطنية الخاصة، والأملاك السطحية المتصلة بها، وكذا مدة عقد الامتياز، وتحديد مبالغ الإتاوات التي يمكن دفعها . ولتحديد كيفيات تحويل حق الانتفاع الدائم إلى حق الامتياز نص المشرع الجزائري في القانون 10-03، على إجراءات تحويل هذا الحق بدءا بإيداع ملف التحويل، ودراسته، ليتم إرساله إلى إدارة أملاك الدولة من أجل إعداد عقد الامتياز، وفي حالة تخلف المنتفعين عن إيداع ملفاتهم، فهنا يتم إعذارهم من طرف المدير الولائي للديوان الوطني للأراضي الفلاحية، بواسطة إعذارين، وبعد انقضاء أجل 18 شهرا بعد الإعذارين، يعتبر المنتفعين متخلين عن حقوقهم، ولإدارة أملاك الدولة الحق في استرجاع الأراضي الفلاحية الممنوحة لهم . Abstract The subject of the agricultural concession contract is considered one of the most important topics that contribute to the promotion of investment in Algeria, and this is what prompted the Algerian legislator to organize it, whether in terms of the parties to the concession contract, whether they are beneficiaries of the concession contract, or the state in its capacity as the grantor of the concession contract. In addition, the Algerian legislator sought to organize the provisions of the agricultural concession contract, whether in terms of the subject of the concession contract, which is represented in granting lands belonging to private national properties, and surface properties connected to them, as well as the duration of the concession contract, and determining the amounts of royalties that can be paid. To determine the methods of converting the permanent usufruct right into a concession right, the Algerian legislator stipulated in Law 10-03 the procedures for converting this right, starting with the submission of the conversion file, its study, and then sending it to the State Property Administration in order to prepare the concession contract. In the event that the beneficiaries fail to submit their files, the defaulters are warned by the provincial director of the National Office of Agricultural Lands, by means of two warnings. After the expiration of a period of 18 months after the two warnings, the beneficiaries are considered to have relinquished their rights, and the State Property Administration has the right to recover the agricultural lands granted to them.
