أ.د/ عـَــــلَّاوَة عمــَــــارَة بَيْنَ الاِعْتِنَاقْ وَالقتل: حَالْ وَمَآلْ الإباضيّين المَغَارِبَة مِنْ خِلَالِ النُّصُوصِ اَلفِقْهِيَّةِ الَمالِكيَّة

Résumé: عالج الباحث في هذه الدراسة تطوّر نظرة النصوص الفقهية المالكية إلى الجماعات الإباضية ببلاد المغرب، وما نتج عن ذلك من أحكام فقهية وفتاوى دينية تدين أتباع هذا المذهب في أغلب الأحوال، وقد حاول تتبّع الظروف السياسية الكامنة وراء هذه الفتاوى ومدى إطّلاع فقهاء المذهب المالكي على تفاصيل مذهب مخالفيهم، ومن النتائج التي توصل إليها باختصار هي وجود تحامل مذهبي مدعوم سياسيا وغير مبرر في غالب الأحيان، لاسيما أن بعضها تؤكد ضعف فهم خبايا عقيدة الآخر وفقهه وتنظيراته السياسية مما أدى إلى ظهور فتاوى مجحفة وغير سليمة. In this study, the researcher dealt with the evolution of the Maliki jurisprudencial (fiqh) texts view towards the Ibadi groups in Maghreb, and the resulting jurisprudential rulings and religious fatwas condemning the followers of this doctrine in most cases. The study attempts not only to track the political conditions surrounding these fatwas but also to detect the extent towhich Maliki doctrine's jurists are familiar with their opponents' doctrine's details. Aamong the results the researcher reached is the presence of doctrinal clamping supported politically and often unjustified, especially as some of them confirm a lack of understanding the secrets of the other's believes, jurisprudence and political theories, the fact that led to the emergence of unfair and improper fatwas.
