نظام المصالحة الجزائية في التشريع الجنائي الجزائري

Résumé: المصالحة الجزائية هي أحد أهم صور العدالة التصالحية، وأسلوب متميز لإنهاء المنازعات الجزائية، بعيدا عن الإجراءات الجزائية التقليدية، يستمد مشروعيته في الجرائم ذات الطابع المالي والاقتصادي من خلال النظام القانوني الذي يحدد نطاقها وآثارها، مما جعل معظم التشريعات المقارنة ومنها التشريع الجزائري تستعين بها استجابة لتحقيق بعض الاعتبارات العملية كالتخفيف من تكدس القضايا أمام المحاكم، وتفادي إشكالية بطء سير الإجراءات، وتوفير الوقت والجهد والمصاريف للمتهم والمجني عليه والقضاء، إضافة الى محو الأحقاد والضغائن التي يخلفها الحكم القضائي بين أفراد المجتمع. ونظرا الى كون المصالحة في المواد الجزائية إجراءا استثنائيا فقد حرصت مختلف القوانين التي تجيزها على إخضاعها الى شروط محددة، وعلى حصر آثارها وهو ما ستناوله في هذه الورقة البحثية بإتباع المنهج الوصفي التحليلي. Criminal reconciliation is one of the most important forms of restorative justice and a distinct way of ending criminal disputes, apart from traditional criminal proceedings, derived from its legitimacy in crimes of a financial and economic nature through the legal system which defines their scope and effects. This has led to the use of most comparative legislation, including Algerian legislation, in response to certain practical considerations, such as reducing the overcrowding of cases before the courts, avoiding the problem of slow proceedings, saving time, effort and expenses for the accused, the injured and the judiciary, and eliminating the grudges and prejudgings left by the judicial system among the members of society. Since reconciliation in penal materials is an exceptional measure, various laws have made it possible to subject them to specific conditions and to limit their effects, which will be dealt with in this paper by following the analytical descriptive approach.
