اكتساب الحق في ملكية العلامة وفقدانه

Résumé: عالجت هذه الدراسة طريقة اكتساب ملكية العلامة وفقا للقانون الجزائري المنظم للعلامات، وبينت أن هناك شروطا موضوعية يجب أن تتوفر في العلامة لكي تحض بالحماية القانونية كما بينت الدراسة أن الحق في ملكية العلامة يثبت من تاريخ تسجيلها لدى المعهد الوطني الجزائري للملكية الصناعية. وهذا الحق يبقى قائما ومحميا لمدة قانونية قابلة للتجديد لمدة غير متناهية، ولا ينقضي إلا بناءا على إرادة مالك العلامة، أو في حالة توفر سبب من الأسباب التي نص عليها المشرع والتي تكون خارجة عن إرادة مالك العلامة. This study dealt with the method of acquiring the ownership of a mark in accordance with the Algerian law regulating marks, and it showed that there are objective conditions that must be met by the mark in order for it to be prompted by legal protection. This right remains in existence and is protected for a legal period that is renewable for an infinite period, and it does not expire except at the will of the trademark owner, or in the event that one of the reasons stipulated by the legislator is available, which are beyond the will of the trademark owner.
