حماية المستهلك من الشروط التعسفية في عقود الاستهلاك

Résumé: يشغل هذا الموضوع بال قطاع اجتماعي واسع بل إنه يمس الجميع بلا استثناء، حتى المنتج الذي يقابل المستهلك، نجده من نواحي أخرى مستهلكا، وبالتالي تحتل حماية المستهلك مساحة واسعة من الاهتمام، خاصة ما تعلق منها بالحماية من الشروط التعسفية في مختلف علاقاته التعاقدية، سيما وأن تلك العقود تغيرت من حيث الشكل والمضمون وطرق الإبرام. فاقتضت الضرورة احتواء أزمة اختلال التوازن في عقود الاستهلاك الذي تحدثه الشروط التعسفية المفروضة على المستهلكين من طرف المهنيين، فنجد أن المشرّع الجزائري قد أقر حماية في مواجهة الشروط التعسفية من خلال القانون رقم 09-03 المؤرخ في 25 فبراير 2009 المتعلق بحماية المستهلك وقمع الغش المعدل والمتمم والقانون رقم 04-02 المعدل والمتمم الذي يحدد القواعد المطبقة على الممارسات التجارية، بالإضافة إلى ما أورده في القواعد العامة كالقانون المدني. الكلمات المفتاحية: عقود الاستهلاك، القانون رقم 09-03، الشروط التعسفية، القانون رقم 04-02، الحماية القانونية. It was necessary to contain the crisis of imbalance in the consumption contracts caused by arbitrary conditions imposed on consumers by professionals, and we find that the Algerian legislator has passed protection in the face of arbitrary conditions through Law No. 09-03 of February 25, 2009 on consumer protection and the suppression of fraud and law No. 02-02 Amended and Complementary Determining the Rules Applied to Commercial Practices, in addition to what was mentioned in general rules such as the Civil Law.
